Approval Of Trump Trademark In Line With Law Says China Defending Its Decision




A senior Chinese commercial official said on Friday to the media that primarily since they met legal standards, initial approval on dozens of new trademarks in China for U.S. President Donald Trump trademarks were granted.
 
The U.S. president and his family were given protection in China were they to develop the "Trump" brand in the market after China's trademark office in recent weeks green-lighted 38 trademark applications linked to Trump.
 
However, the U.S. president could face potential conflicts of interest related to the extensive business affairs of his family, say politicians and rights groups as they expressed their concerns based on the ties between politics and business of Trump.
 
 Trump’s position as president could prompt preferential treatment of his businesses and this is the concern that some U.S. law makers are expressing and they have already raised questions about this.
 
Clarifying their position on the Trump trademark issue, Zhang Mao, the head of China's State Administration for Industry and Commerce (SAIC), told reporters after a briefing on the sidelines of the country's annual parliament session that China examines millions of trademark applications every year and they are processed according to schedule.
 
"Our trademark examination process is open and transparent," said Zhang, whose SAIC runs the trademarks office.
 
Zhang said: "(They) were processed completely according to trademark law. You can go check", when asked by reporters whether their approval was at all linked to Trump's status as president.
 
A trust overseen by one of his sons and a Trump Organization executive, is now responsible for all of the business that Trump used to run and the U.S. President has already made this announcement of handing over control of his business to this trust. Trump is a wealthy real estate developer and has had business interests and projects all over the world. However Trump has retained the discretion of revoking the functioning of the trust to himself and according to this he can, at any point in time, break up the trust and take back control over his business. He also remains linked to the trust financially as he is the trust’s sole beneficiary.
 
Preliminary approval was given in two lists published by the trademark office on Feb. 27 and Monday for the trademarks - mostly variations in English and Chinese on the name "Donald Trump".
 
Retail shops, restaurants, bars, bodyguards, branded spas, massage parlours, golf clubs, hotels, insurance, finance and real estate companies are businesses that are included in the cover by the trademarks.
 
Mostly to the address of Trump Tower on Fifth Avenue in New York and registered to "Donald J. Trump", Trump's lawyers applied for the trademarks in April last year.
 
For around a 90-day period, the preliminary approvals are open to be challenged. They will be formally registered in late May and early June respectively barring objections.
 
From business sectors such as apparel in the Philippines to golf clubs in Australia and property in Japan and South Korea, Trump and his family, like many business owners, hold trademarks around the world.
